1. Acceptance

These Terms of Use are an agreement between you and The NexGen Leaders Foundation. By using this website — browsing it, applying to a program, registering as a mentor, or making a donation — you agree to them.

If you do not agree with these terms, please do not use the website. If you are under 18, you may only use this website and submit information through it with the permission of a parent or legal guardian.

2. Who You Are Dealing With

The following details are provided in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

3. Using This Website

You may use this website for lawful purposes only. You agree not to:

• Submit false, misleading, or fraudulent information through any of our forms.
• Impersonate another person, or apply on someone's behalf without their knowledge.
• Attempt to gain unauthorised access to our systems, accounts, or database.
• Interfere with the website's operation, including by introducing malicious code or overwhelming it with automated requests.
• Copy, scrape, or harvest content or personal information from the site.
• Use the site to harass, abuse, or harm anyone — particularly the young people we serve.

We may suspend or refuse access to anyone who breaches these terms, and we will report unlawful conduct to the relevant authorities.

4. Program Applications

Submitting an application does not guarantee acceptance. Places on our programs are limited, and we select participants at our discretion based on the criteria for each intake.

• You must provide accurate and truthful information. A material misrepresentation is grounds for withdrawing a place.
• Applicants under 18 require the consent of a parent or legal guardian, which we will ask for in writing before an application proceeds.
• Some programs carry a participation fee. Where a fee applies, it will be stated clearly before you commit, and financial need will never be the reason a young person is turned away.
• Participation is subject to our program rules and code of conduct, which we will share with you on acceptance. Serious or repeated breaches may end your participation.
• Program dates, content, venues, and facilitators may change. We will give you as much notice as we reasonably can.

5. Mentors & Volunteers

Registering as a mentor or volunteer is an expression of interest, not an appointment. Because our work brings adults into contact with young people, every mentor and volunteer is subject to a vetting process, which may include background and reference checks. We may decline any registration without giving reasons.

Mentors and volunteers act in a voluntary capacity. Nothing in these terms creates an employment relationship, and no remuneration is payable unless separately agreed in writing.

6. Donations

Donations to the Foundation are voluntary. You receive no goods or services in return for a donation, and a donation does not entitle you to a place on a program, to influence our programs, or to any control over how funds are applied.

• All donations are processed in South African Rand (ZAR).
• Payments are handled by PayFast (Pty) Ltd on its own secure checkout page. We never receive or store your card or banking details.
• You warrant that you are the authorised holder of the card or account used, and that the funds are lawfully yours to give.
• A donation is only complete once PayFast confirms the payment to us. A confirmation on your screen is not, on its own, proof of a completed payment.
• We apply donations to our charitable objectives. We may direct funds to the area of greatest need unless we have agreed a specific use with you in writing.
• Choosing a monthly donation authorises PayFast to collect the same amount from you each month until you cancel.

7. Refunds & Cancellations

Once-off donations

Because donations are voluntary gifts rather than purchases, they are generally non-refundable. We will, however, refund a donation in full where:

• It was made in error — for example, you entered R5 000 instead of R500 — and you tell us within 30 days.
• It was duplicated by a technical fault.
• It was made fraudulently, without the cardholder's authority.

To request a refund, email info@nexgenleaders.org with the date, the amount, and the email address you used. We aim to review requests within 5 business days. Approved refunds are paid back to the original payment method, and can take a further 5 to 10 business days to reflect, depending on your bank.

Monthly donations

You can cancel a monthly donation at any time, with no notice period and no penalty. Email info@nexgenleaders.org and we will cancel it, or cancel it yourself through PayFast. Cancelling stops all future collections. It does not automatically refund payments already collected, though the grounds above still apply to each of them.

Program fees

Where a program carries a participation fee, the refund terms for that fee will be set out in the program's own joining information before you pay.

8. Content You Submit

You keep ownership of everything you submit to us — your application, your message, your story. By submitting it, you give us permission to use it for the purpose you submitted it for.

We sometimes want to share a participant's story, photograph, or quote in our reports, on social media, or on this website. We will always ask for your specific, separate written permission first, and for anyone under 18, from a parent or guardian. You can withdraw that permission at any time and we will stop using the material going forward.

You confirm that anything you submit is your own, is accurate, and does not infringe anyone else's rights.

9. Our Content

The content on this website — our name, logo, program materials, text, images, and design — belongs to The NexGen Leaders Foundation or is used with permission, and is protected by copyright and trade mark law.

You may read, share, and link to our pages, and you may quote us with attribution. You may not reproduce our content commercially, present it as your own, or use our name or logo to imply an endorsement or partnership that does not exist, without our written permission.

10. External Links

This website links to other sites, including PayFast and our social media pages. We do not control those sites and are not responsible for their content, their security, or how they handle your information. Their own terms and privacy policies apply once you leave our site.

11. Availability & Accuracy

We work to keep this website accurate and available, but we provide it "as is". We do not guarantee that it will be uninterrupted, error-free, or free of viruses, and we may change, suspend, or withdraw any part of it at any time.

Information on this site is provided for general information about our work. It is not professional, legal, financial, or educational advice, and you should not rely on it as such.

12. Limitation of Liability

To the fullest extent permitted by South African law, the Foundation, its trustees, directors, staff, mentors, and volunteers are not liable for any indirect, incidental, or consequential loss arising from your use of this website, including lost profits, lost data, or business interruption.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded — including your rights under the Consumer Protection Act 68 of 2008, where it applies to you.

You agree to indemnify the Foundation against any claim arising from your breach of these terms or your unlawful use of this website.

13. Privacy

How we handle your personal information is set out in our Privacy Policy, which forms part of these terms. Please read it — it explains what we collect, who we share it with, and the rights POPIA gives you over it.

14. Changes to These Terms

We may update these terms from time to time. The "last updated" date at the top of this page always reflects the current version, and the version in force is the one published here when you use the site. If we make a material change, we will make a point of highlighting it.

15. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of the South African courts.

If any part of these terms is found to be unenforceable, the rest remains in force. If we do not immediately enforce a right, we do not give it up.
